COMPANY
POLICIES FOR ACENET SUBSCRIBERS
The following details current policies of Acenet Internet Services (Acenet)
for Subscriber accounts. They should be read in conjunction with the company's
Subscriber Agreement.
Acenet reserves the right to alter these policies at any time without
notice to the Subscriber.
General Policies
These conditions apply to all Internet accounts in addition to the
Account type policies unless otherwise specified.
Email
a.
Five (5) email accounts
are provided for each Internet Access account unless otherwise specified.
b.
Maximum email size is 10
Mb per individual email.
c.
Maximum allowance per
individual mailbox at any one time is 50 Mb or 1000 individual messages.
d.
Mail left in mailboxes
for over three (3) months will be deleted. Worldclient trash and sent items
folders are cleared every seven (7) days.
e.
When an account becomes
inactive, email will continue to be collected for seven (7) days. After this
period incoming email will be rejected and any emails remaining in the mailbox
will be deleted.
f.
POP session mail
collection schedules/intervals to Acenet mail servers must be set to a minimum
of ten (10) minutes. Acenet reserves the right to disconnect any email account
collecting POP3 mail at an interval of less than ten (10) minutes.
g.
Backups of email
messages, address books and/or Worldclient settings are not provided.
h.
Email spam filtering is
provided free and by default for each individual mailbox. Written notification
must be provided to be exempt from the spam filtering service.
i.
Acenet is not responsible
for any email message that is not delivered, received or appears missing.
Homepages
a.
One (1) homepage space is
provided. Maximum size is 20 Mb.
b.
Traffic to and from the
homepage is limited to 20 Mb per month. Traffic in excess of 20 Mb will be
billed to the user at a rate of 15 cents per Mb.
c.
When an account becomes
inactive, access to the homepage will be suspended. After seven (7) days the
homepage will be removed and the contents deleted.
d.
Access to files in
homepage space is provided through FTP only.
e.
Users must be connected
to Acenet to use FTP to connect to their homepage.
f.
Backups of homepages are
not provided.
Other
a.
Acenet will email out all
internet invoices and receipts in PDF or Plain Text format to the email address
specified on the account. By default, invoices are generated and emailed out
fourteen (14) days prior to the Due Date. If payment is not received fourteen
(14) days after the Due Date, the service(s) may be suspended at Acenet’s
discretion until payment is received. The user is liable for all charges
incurred by the suspension. Reconnection of services may take up to twenty-four
(24) hours.
b.
Acenet provides setup
disks and instruction sheets to configure the Internet Access. Telephone
support for internet configuration may incur a Setup Fee of $25.00.
c.
Telephone support is for
basic Internet setup, getting connected, Browser setup and/or Email setup.
Subscribers are expected to have followed the setup instructions and/or run the
setup CD before requesting telephone support. Support on any other issue will
not be given.
d.
Accounts
set to have payments automatically deducted by Credit Card or Direct Debit will
be processed on the Due Date of the invoice(s) where invoice(s) equals or
exceeds $10.00.
e.
Acenet
reserves the right to suspend services or charge for outgoing traffic (uploads)
where it exceeds incoming traffic (downloads) by a ratio of 3 to 1.
f.
Acenet is not responsible
for any damage caused to the user’s equipment even where purchased from Acenet.
Any modem purchased from Acenet is subject to a twelve (12) month back to base
warranty as outlined in the modem manual.
Acenet recommends disconnecting any internet or computer equipment from
the telephone line and power socket during any electrical storms or when known
work is being performed on either service.
Prepaid Hourly User Accounts
These conditions apply in addition to the General Policies of Acenet
(available at www.acenet.net.au/policy/companypolicy.asp).
Dial in Access
a.
Internet Access is
limited to 56k or 64k ISDN modems.
b.
The minimum available
block of hours to purchase is 25 hours.
c.
There is no set up fee
provided subscriber sets up their own computer.
d.
Multiple simultaneous
connections from different locations and Multi Modem, simultaneous connections
from the same computer (Multilink) is permissible.
e.
Should an account balance
fall below 15 minutes, access to the Internet will be suspended.
f.
The minimum increment of
access usage is one second.
g.
All blocks of internet
hours must be used within two (2) years from date of purchase or they will
expire.
h.
Accounts detected causing
excessive flows indicative of virus, spyware or spam activity are subject to
disconnection and suspension. The account will remain suspended until the
problem is rectified.
i.
If there is no usage of
the Internet access account by way of dial in for a reasonable period
(currently 30 days), Acenet reserves the right to suspend email, FTP and/or Web
services until usage resumes.
Other
a.
Acenet will refund a
subscribers’ fee provided they request it within 7 days of the purchase date and
have used less than 5 hours.
Unlimited Dialup Accounts
These conditions apply in addition to the General Policies of Acenet
(available at www.acenet.net.au/policy/companypolicy.asp).
Dial in Access
a.
Internet access is
limited to 56K or 64K ISDN modems.
b.
Simultaneous connections
are not permissible.
c.
A four (4) hour session
limit applies.
d.
Access fees are billed in
advance.
e.
There is no set up fee
provided Subscriber sets up their own computer.
f.
Accounts detected causing
excessive flows indicative of virus, spyware or spam activity are subject to
disconnection and suspension. The account will remain suspended until the
problem is rectified.
Other
a.
A minimum one (1) month
contract period applies.
b.
Termination of the
account, after the minimum period, must be given in writing with 30 days
notice. Accounts terminated without notice will continue to incur fees until 30
days after written notice is received.
Residential and
These conditions apply in addition to the General Policies of Acenet
(available at www.acenet.net.au/policy/companypolicy.asp).

“Provision Date” means the date the ADSL service became available at the
telephone exchange level.
“Service number” means the telephone number/line the ADSL service is
connected to. The ADSL service is fixed to the service number.
“Downloads” means
to any data received from the internet by the ADSL modem connected to the
service number.
a.
Access
fee is billed one month in advance and includes downloads as specified on the
application form. The Access fee is payable monthly regardless of downloads
used. Unused downloads do not carry forward.
b.
Download usage is calculated in megabytes (MB) 1000
megabytes = 1 gigabyte (GB). Excess megabyte usage (download only) is billed at
11c/mb. Excess Traffic fee is capped at the maximum Access fee for each speed
as specified on the Acenet website, www.acenet.net.au.
c. Connection speed slowed to 64K/64K on all plans when
downloads reach 15 GB (excluding 30 GB download limit, which is slowed to
64K/64K at 30 GB).
d.
Data transmission speeds
are shown as ‘downstream/upstream’ speeds, for example 256/64 refers to a speed
of 256kbps for data being downloaded to the computer and 64kbps for data
uploaded from the computer. These speeds may not be achieved in some cases; for
example, constraints include modem, line quality and the computer’s
capabilities.
e.
Change to the speed of the plan incurs a Change to
Plan fee ($55.00). Users are permitted to change their plan (within the same
speed) once every three (3) months without incurring a Change to Plan fee
($55.00). Users may upgrade but are not permitted to downgrade their plan
during the minimum contract period.
f.
Dynamic IP allocation is standard. Fixed IP
available for an additional fee ($11.00 per month).
g.
An active Telstra PSTN line is required for the ADSL
service. Access fee does not include PSTN line rental.
h.
Payments for monthly fees
made by cheque or direct deposit must be made for 3 months in advance. Acenet
accepts payment monthly by automatic deduction of a bank or credit account.
i.
Acenet reserves the right
to suspend services should outgoing data from the users’ connection exceed
three times the download limit or 30 GB, whichever is the lesser, in any
billing period.
j.
Accounts detected causing
excessive flows indicative of virus, spyware or spam activity are subject to
disconnection and suspension. The account will remain suspended until the
problem is amended to Acenet’s satisfaction.
k.
Not suitable for Mail/Web servers or VPN use.
Application,

Residential Prepaid Wireless Broadband Accounts
These conditions apply in addition to the General Policies of Acenet
(available at www.acenet.net.au/policy/companypolicy.asp).
Internet Access
a.
The minimum Top Up
Traffic is 500 MB valid for 30 days.
b.
Traffic usage is calculated in megabytes (MB) 1000
megabytes = 1 gigabyte (GB) and includes uploaded and downloaded data. Services
that exceed 8 GB of traffic during a calendar month will be suspended, until
the first day of the next calendar month.
c.
Prepaid Traffic is valid
until midnight of the last day of the Expiry Term.
d.
Purchasing additional
Traffic before the end of the current Traffic’s Expiry Term will carry over the
remaining Traffic to the new Expiry Term.
e.
Dynamic IP allocation is standard.
f.
Accounts detected causing
excessive flows indicative of virus, spyware or spam activity are subject to
disconnection and suspension. The account will remain suspended until the
problem is amended to Acenet’s satisfaction.
g.
Not suitable for Mail/Web servers or VPN use. Not
suitable for use in a static location.
Application,

Residential Wireless Broadband Accounts
These conditions apply in addition to the General Policies of Acenet
(available at www.acenet.net.au/policy/companypolicy.asp).
Internet Access
a.
Access
fee is billed one month in advance and includes Traffic as specified on the
application form. The Access fee is payable monthly regardless of downloads
used. Unused Traffic does not carry forward.
b.
Traffic usage is calculated in megabytes (MB) 1000
megabytes = 1 gigabyte (GB) and includes uploaded and downloaded data. Excess traffic
is billed at 8c/mb. Services that exceed 8 GB of traffic within one billing
month are suspended until the next billing month.
c.
Any change to the Traffic limit incurs a Change to
Plan fee ($11.00). Users may upgrade but are not permitted to downgrade their Traffic
limit during the minimum contract period.
d.
Dynamic IP allocation is standard. Fixed IP available
for an additional fee ($5.00 per month).
e.
Payments for monthly fees
made by cheque or direct deposit must be made for 3 months in advance. Acenet
accepts payment monthly by automatic deduction of a bank or credit account.

Residential ADSL2+ LSS Broadband Accounts
These conditions apply in addition to the General Policies of Acenet
(available at www.acenet.net.au/policy/companypolicy.asp).
Internet Access
“Provision Date” means the date the service became available at the
telephone exchange level.
“Service number” means the telephone number the ADSL2+ LSS service is connected to.
“Service” means
the ADSL2+ LSS service and the fixed line telephone service.
“Downloads” means
to any data received from the internet by the ADSL modem connected to the
service number.
“Peak” period is
set to between 05:00 and 01:00 of the following day.
“Offpeak” period
is set to between 01:00 and 05:00.
a.
Access
fee is billed one month in advance and includes downloads as specified on the
application form. The Access fee is payable monthly regardless of downloads
used. Unused downloads do not carry forward. For 30GB and 50GB plans, normal
AcePhone billing policies for Landline Telephone Accounts apply as outlined in
the AcePhone Company Policy, http://www.acephone.net.au/policy/companypolicy.asp.
b.
Download usage is calculated in megabytes (MB) 1000
megabytes = 1 gigabyte (GB). Accounts that reach and/or exceed the specified Peak
or Offpeak download limit within the billing month will have the speed of the
connection reduced to 128k/128k for the remainder of the billing month
excluding where otherwise specified by special offer.
c.
Downloads incurred during
the Offpeak period are counted separately to downloads incurred during the Peak
period.
d.
Data transmission speeds
are can only be guaranteed to reach the normal parameters for a
1500kbps/256kbps speed ADSL connection. Many factors affect the speed of the
connection including but not limited to your distance from the telephone
exchange, your telephone line condition, your hardware and software, the source
of your download, and general internet traffic.
e.
Users are permitted to change their download limit once
every three (3) months without incurring an Administration charge. Users may
upgrade but are not permitted to downgrade their plan during the minimum
contract period.
f.
Dynamic IP allocation is standard. Fixed IP is available
for an additional fee ($11.00 per month).
g.
Acenet reserves the right
to suspend services should outgoing data from the users’ connection exceeds
three times the download limit or 30 GB, whichever is the lesser, in any
billing period.

“Service number” means the telephone number the ADSL2+ ULL (previously known as the HiSpeed ADSL) service is connected to.
“Service” means
the ADSL2+ ULL (previously known as the HiSpeed ADSL) service and the fixed
line telephone service.
“Downloads” means
to any data received from the internet by the ADSL modem connected to the
service number.
a.
Access
fee is billed one month in advance and includes downloads as specified on the
application form and telephone line rental. The Access fee is payable monthly
regardless of downloads used. Unused downloads do not carry forward. Normal
AcePhone billing policies for Landline Telephone Accounts apply as outlined in

connected to. The ADSL service is fixed to the service number.
“Downloads” means
to any data received from the internet by the ADSL modem connected to the
service number.

The Access fee is payable monthly regardless of downloads used. Unused
downloads do not carry forward.
b.
Download usage is calculated in megabytes (MB) 1000
megabytes = 1 gigabyte (GB). Excess megabyte usage (download only) is billed at

c.
Data transmission speeds

accepts payment monthly by automatic deduction of a bank or credit account.

Acenet reserves the right
to suspend services or charge for outgoing data from the users’ connection where
it exceeds three times the download limit or 30 GB, whichever is the lesser, in
any billing period.
i.
Accounts detected causing
excessive flows indicative of virus, spyware or spam activity are subject to
disconnection and suspension. The account will remain suspended until the
problem is amended to Acenet’s satisfaction.
Application,
Installation and Cancellations
a.
Applications will not be
processed until first payment or payment authorisation (for automatic Credit
Card and Direct Debit transactions) is received.
b.
Accepted applications
will be processed within two (2) business days and Acenet will endeavour to
provision the DSL service within fourteen (14) business days but cannot
guarantee availability or a date of commencement.
c.
Transfers from an existing DSL connection with a
participating ISP (Rapid Transfer) incur a Churn fee in lieu of the Setup Fee.
d.
If the telephone line or number is altered or disconnected
this may disconnect the DSL service and incur an Early Termination fee if
within twelve (12) months of provision date and Setup fee to reconnect service.
e.
If the telephone line is
terminated before the service is provisioned, an Early Termination fee applies,
in addition to any actual expense which Acenet has incurred.
f.
To move an ADSL service
to a new premise or service number, a Relocation Application must be submitted
to Acenet thirty (30) days prior to the move. If within twelve (12) months of
provision date an Early Termination fee applies and a Setup fee for the new
service number also applies.
g.
To terminate the contract
within the minimum contract period, written notice must be provided to Acenet
with thirty (30) days notice. User will be liable for an Early Contract
Termination fee plus any unpaid Excess Traffic or Access fees incurred on the
account until the termination date. If the service is terminated before the end of contract an Early
Termination fee applies. The
Early Termination fee is calculated by the sum of the remaining months of the
contract times the current Access fee.
h.
Computer equipment utilising
the service must meet minimum requirements. Users are permitted to use a modem
of their choice but accept that only limited support is provided for the
configuration and troubleshooting.
i.
Termination of the
account, after the minimum period, must be given in writing with thirty (30)
days notice. Accounts terminated without notice will continue to incur fees
until thirty (30) days after written notice is received.
Mailscan Accounts
These conditions apply in addition to the General Policies of Acenet
(available at www.acenet.net.au/policy/companypolicy.asp).
Other
a.
A minimum twelve (12)
month contract period applies. If the account is terminated before the end of
contract any credit for the remaining period is forfeit.
b.
Termination of the
account, after the minimum period, must be given in writing with fourteen (14)
days notice. Accounts terminated without notice will continue to incur fees
until fourteen (14) days after written notice is received.
c.
This service is not
provided as a full Virus protection program. Users are advised to have Virus
protection installed on their computer to protect against viruses not spread by
email.
d.
Telephone support is for
basic Email setup only.
Email Only Accounts
These conditions apply in addition to the General Policies of Acenet
(available at www.acenet.net.au/policy/companypolicy.asp).
Other
a.
A minimum twelve (12)
month contract period applies. If the account is terminated before the end of
contract any credit for the remaining period is forfeit.
b.
Termination of the account,
after the minimum period, must be given in writing with fourteen (14) days
notice. Accounts terminated without notice will continue to incur fees until fourteen
(14) days after written notice is received.
c.
Telephone support is for
basic Email setup only.
Web Hosting Accounts
These conditions apply in addition to the General Policies of Acenet
(available at www.acenet.net.au/policy/companypolicy.asp).
a.
Web hosting is provided
with the services available for each account type as detailed on the web
hosting option plans.
b.
Account charges are
monthly, quarterly or yearly, in advance. If payment is not received within seven
(7) days from date of invoice, the account (and any FTP, Mail and/or web
access) will be suspended.
c.
A once-off set up fee of
$82.50 applies. If an account becomes inactive for over thirty (30) days,
Acenet reserves the right to charge a re-connection / setup fee of $82.50.
d.
Traffic to and from the
website is limited by the type of domain account. Traffic in excess of the
specified traffic will billed to the user at a rate of 15 cents per Mb. Extra
traffic charges are billed monthly in arrears. Data usage is calculated in
megabytes, 1000 megabytes = 1 gigabyte.
e.
Backups of web site
content are the responsibility of the customer.
Email
a.
Email is provided with
the services available for each account type as detailed on the web hosting
option plans.
Additional FTP
a.
Traffic to and from
additional FTP accounts is recorded as traffic to and from website.
Other
a.
A minimum twelve (12)
month contract period applies. If the service is terminated before the end of
contract an Early Termination fee applies. Accounts that terminate the
account within the minimum contract period will be charged an Early Termination
fee. The Early Termination fee is calculated by the sum of the remaining months
of the contract times the current Access fee.
b.
Termination of the
account, after the minimum period, must be given in writing with thirty (30)
days notice. Accounts terminated without notice will continue to incur fees
until thirty (30) days after written notice is received.
c. Telephone support is for basic domain set-up,
configuration and/or Email set-up.
d. All domain name registrations and renewals are
non-refundable.
Co-Hosting Accounts
These conditions apply in addition to the General Policies of Acenet
(available at www.acenet.net.au/policy/companypolicy.asp).
a.
Co-hosting is provided
with the services available for each account type as detailed on the co-hosting
option plans.
b.
Account charges are
monthly, quarterly or yearly, in advance. Payments for monthly fees by cheque
or direct deposit most be made for six (6) months in advance.
c.
All units are supplied
with UPS power and generator backup. Customer must supply own network
hub/switch if connecting more than one unit.
d.
Access to facilities
available Monday to Friday 8:30am to 5:30pm. After hours callout fee $150,
includes first hour, thereafter $75 per hour.
e.
Extra megabyte usage
applies to data in excess of the included data. Traffic includes any data
received from or sent to the internet by the unit. Extra traffic charges are
billed monthly in arrears. Data usage is calculated in megabytes, 1000
megabytes = 1 gigabyte.
f.
Units detected causing
excessive flows indicative of virus, spyware or spam activity are subject to
disconnection and suspension. The unit will remain suspended until the problem
is rectified.
Other
a.
A minimum twelve (12)
month contract period applies. If the service is terminated before the end of
contract an Early Termination fee applies. Accounts that terminate the
account within the minimum contract period will be charged an Early Termination
fee. The Early Termination fee is calculated by the sum of the remaining months
